These Terms & Conditions (“Terms”) govern your access to and use of the websites, applications, and services provided by ZOWN REALTY INC. (“Zown”, “we”, “us”, or “our”). By using our services, you agree to these Terms and to our Privacy Policy.

We provide technology-enabled real estate services to help homebuyers and sellers discover properties, schedule showings with licensed agents, submit offers, and coordinate transaction steps with partners (e.g., mortgage, legal/escrow). Certain programs (e.g., commission rebates, upfront down-payment boost) may have additional eligibility criteria and separate agreements that supplement these Terms.

Buyer-facing services may include home search tools, showings with local agents, AI-assisted recommendations, and programs that provide an upfront commission rebate/down-payment boost subject to qualification, applicable law, and program- specific terms communicated at enrollment and incorporated by reference here.

Seller-facing services may include full-service listings, marketing, pricing guidance, and flexible commission structures (including flat-fee options where available). Final pricing and inclusions are set out in your signed listing agreement.

You agree to provide accurate information, keep credentials secure, and use the services only for lawful purposes. You must not interfere with or disrupt the platform, attempt to access non-public areas, or misuse any features.

By providing your contact information, you authorize us to contact you about your account, requests, or services. Marketing communications require your consent and you may opt out at any time as described below and in our Privacy Policy.

These SMS Terms apply when you opt in to receive text messages from Zown.

• Opt-In Method: You may opt in to receive SMS messages from Zown Realty Inc. in the following way:
  • By submitting an online form
• No Sharing for Marketing: Mobile opt-in, SMS consent, and phone numbers collected for SMS communication purposes will not be shared with any third party or affiliates for marketing purposes.
• Message Frequency: Message frequency may vary based on your interactions and program activity.
• Fees: Standard message and data rates may apply per your carrier plan.
• Opt-Out: Reply STOP to any message to unsubscribe at any time. You may also email info@zown.ca to request removal.
• Help: Reply HELP for assistance or contact info@zown.ca.
• Keywords: Supported commands include STOP and HELP.
• Eligibility: You must provide your own phone number, be the account holder or authorized user, and be 18+ or the age of majority in your jurisdiction.
• Availability: Delivery may be limited by your carrier or device. We are not responsible for delays or failures due to carrier issues or network coverage.

Our data practices are described in our Privacy Policy. By using the services, you acknowledge that we will collect, use, and share information as described there. The Privacy Policy is incorporated into these Terms.

The services, site content, logos, product names, and proprietary programs (including pricing models and commission-rebate structures) are owned by Zown or our licensors and are protected by law. No license is granted except as necessary to use the services as permitted by these Terms.

We may integrate or link to third-party tools and partners (e.g., maps, payment, mortgage, legal/escrow). Those services are governed by their own terms and policies; we are not responsible for their content or practices.

Services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, or that results will meet your requirements.

To the maximum extent permitted by law, Zown will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability arising out of or related to the services will not exceed the amounts you paid (if any) to Zown for the services giving rise to the claim in the 12 months preceding the event.

You agree to defend, indemnify, and hold harmless Zown and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the services or violation of these Terms.

These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada, without regard to conflict-of-law rules. Before filing a claim, the parties will attempt to resolve disputes informally by emailing info@zown.ca. If not resolved within 30 days, disputes will be submitted to binding arbitration on an individual basis in Ontario, to the extent permitted by law. Class or representative actions are waived.

We may update these Terms from time to time. Changes are effective when posted to this page with an updated “Last update” date. Your continued use after changes constitutes acceptance.
